BENGKALIS (pesisirnasional.com)- Pemkab Bengkalis kembali diterpa isu praktik korupsi. Dalam hal ini, perihal Bupati Bengkalis Amril Mukminin memberikan bonus kepada kafilah MTQ yang diduga sebagai gratifikasi.
Adalah, pemilik akun Simon yang memposting beberapa foto serta tulisan di facebook miliknya.
“PAK KETUA KPK JAKARTA. Apakah pemberian hadiah seperti poto dibawah ini termasuk korupsi gratifikasi?. Mohon bpk/ibu Kpk Kpk periksa korupsi jenis gratifikasi seperti ini”.
Demikianlalah kata-kata yang ditulis Simon dalam status Facebooknya yang dipublikasikan Sabtu, 29 Desember 2018 pada pukul 11.28 WIB, dengan menyertakan tiga buah foto. Salah satu foto yang dimaksud adalah foto Bupati Amril Mukminin yang tengah menyerahkan “dumi” bonus kepada salah seorang penerima.
Selain itu, pada hari yang sama, tepatnya pada pukul 11.37 WIB, Simon kembali memposting status di akun fb milikinya dengan menyertakan 13 foto.
Dan tulisnya, “KPK JAKARTA HARUS SERIUS MENANGANI KASUS KORUPSI SEPERTI GRTATIFIKASI PEMBERIAN HADIAH PENGHAPAL Al-quran 30 jus. Ada 20.500.000 sebanyak 25 orang, 20.000.000. Sebyk 25 org, 18.000.000 sebyk 25 org. 10.000.000 sebyk 25 org. Dikantor camat mandau pd hari Sabtu 29 Desember 2019,” tulisnya.
Dan, pada pukul 19.10 WIB, dia mengomentari sendiri status tersebut, “Rakyat perlu ketegasan dlm hal korupsi gratifikasi seperti ini. Jgn tebang pilih. Hal2 kecil pun uang negara dikorupsikan. Kpk tdk bisa di dikte oleh kepala daerah. KPL hrs independen, dan betul2 serius memberantas korupsi di indonesia, khususnya Kabupaten Bengkalis”.
Selanjutnya, pada pukul 21.49 WIB, dia kembali membuat status serupa. Statusnya yang ketiga ini menyertakan 29 foto yang berkaitan dengan kedua kegiatan tersebut.
“KPK jakarta harus cepat tanggap masalah kasus korupsi gratifikasi spt gambar dibawah ini. Dan segera menangkapnya. Jgn sampai dilepaskan. Supaya masyarakat Mandau Duri percaya pada KPK jakarta pusat,” tulisnya.
“KPK tdk boleh di dikte oleh kepala daerah. KPK harus tegas dalam menindak lanjutin kasus pelanggaran hukum korupsi gratifikasi. Semoga KPK dpt bekerja lebih baik lagi. Utk menangkap korupsi lainnya di Pemkab. Bengkalis. Merdeka. Terimakasih,” sambung Simon disatusnya yang ketiga tersebut.
Masih ada beberapa status Simon yang berkaitan yang kegiatan pemberiaan bonus qori-qoriah dan penghafal Al-qur’an 30 juz tersebut.
Bukan sampai disitu saja, sebagian dari statusnya itu dikirimkannya kembali diakun miliknya. Misalnya status kedua, ditampilkannya kembali di dinding fb-nya di waktu yang sama, pukul 21.49 WIB.
Guna menghindari munculnya salah persepsi dari masyarakat terhadap pemberian bonus qori-qoriah dan penghafal Al-qur’an 30 juz itu, Pelaksana Tugas Kadis Kominfotik Johansyah Syafri merasa perlu memberikan penjelasan.
Sebutnya, “kedua kegiatan tersebut adalah bagian dari program Pemkab Bengkalis. Sepengetahuan kami, hal itu tidak bertentangan dengan Undang-Undang (UU) Pemberantasan Tindak Pidana Korupsi (UU No 31/1999 yang telah diubah menjadi UU No 20/2001),” jelas Johan, Rabu, 2 Januari 2019.
Johan menjelaskan, pemberiaan bonus yang diserahkan Bupati Amril tersebut, esensinya sama dengan pemberian bonus dan penghargaan oleh Presiden Joko Widodo kepada atlet-altet dan pelatih peraih 98 medali di Asian Games 2018.
Adapun besaran bonus yang diberikan Presiden untuk atlet perorang untuk peraih medali emas Rp1,5 miliar, perak Rp500 juta dan perunggu Rp250 juta. Sedangkan untuk atlet beregu Emas Rp750 juta per orang, Perak Rp300 juta per orang dan Perunggu Rp150 juta per orang.
“Sepegentahuan kami pemberian bonus, baik yang diberikan Bupati Amril dan Presiden Jokowi Dodo tersebut bukan termasuk gratifikasi. Kalau termasuk gratifikasi, tentu presiden tak mungkin memberikan bonus tersebut. Simon menulis status tersebut difb-nya, mungkin lantaran dia belum begitu paham apa itu gratifikasi,” jelas Johan.
Sekedar informasi, Gratifikasi adalah pemberian dalam arti luas yang meliputi pemberian uang tambahan (fee), hadiah uang, barang, rabat (diskon), komisi pinjaman tanpa bunga, tiket perjalanan, fasilitas penginapan, perjalanan wisata, pengobatan cuma-cuma, dan fasilitas lainnya.
Gratifikasi dapat diterima di dalam negeri maupun di luar negeri dan dapat dilakukan dengan menggunakan sarana elektronik atau tanpa sarana elektronik.
Sesuai Ketentuan UU No 20/2001, setiap gratifikasi yang diperoleh pegawai negeri atau penyelenggara negara adalah suap, namun ketentuan ini tidak berlaku apabila penerima gratifikasi melaporkan gratifikasi yang diterimanya kepada Komisi Pemberantasan Tindak Pidana Korupsi (KPK) selambat-lambatnya dalam waktu 30 (tiga puluh) hari kerja terhitung sejak tanggal gratifikasi tersebut diterima.(win)
