SLEMAN,Pesisirnasional.com- Mahfud MD menilai, tidak ada yang salah dari tagar #2019GantiPresiden, terlebih jika dikait-kaitkan dengan makar. Meski begitu, Mahfud tidak mau bergabung dalam gerakan #2019GantiPresiden.
Ia mengungkapkan, sampai hari ini masih memiliki permintaan dari kelompok yang membuat tagar 2019 Ganti Presiden yang pernah memintanya bergabung. Kala itu, Mahfud diminta memberi semacam penjelasan kalau 2019 harus ganti presiden.
Mengaku tidak setuju, Mahfud menolak permintaan tersebut. Jika ingin direkam apalagi diviralkan, ia lebih ingin untuk membuat semacam pernyataan pendek dengan bunyi “2019 Pemilihan Presiden”.
Mahfud merasa, pergantian memang boleh saja karena dalam pemilihan itu bisa mengganti atau meneruskan kepemimpinan presiden. Walau menolak ikut, ia tidak merasa ada yang salah dari tagar tersebut.
“Secara hukum tidak ada yang salah, yang penting tidak melanggar hukum. Kalau memang salah, sudah ditangkap lama,” kata Mahfud saat menjadi pembicara dalam Dialog Kebangsaan Universitas Islam Indonesia (UII), Rabu (5/9).
Untuk memahami dari sudut pandang hukum, Mahfud mengingatkan kalau makar itu tertuang di Pasal 104-129 KUHP. Terjemahnya, pertama makar itu merampas kemerdekaan presiden dan wakil presiden.
Kedua, makar itu merencanakan untuk merampas kemerdekaan presiden dan wakil presiden sehingga pemerintahan lumpuh. Ketiga, makar itu gerakan mengganti ideologi Pancasila.
“Tagar itu tidak ada makarnya, istilah makar itu diucapkan orang-orang yang bukan ahli hukum, sebab (tagar) itu aspirasi saja, sama saja dengan 2019 Tetap Presiden atau apa,” ujar Mahfud.
Jika dari segi bahasa, Mahfud berpendapat, makar memang berarti suatu siasat politik. Artinya, kalau ada dua kubu, semisal 2019 Ganti Presiden dan 2019 Tetap Presiden, dua-duanya sama-sama bersiasat.
Terkait aksi-aksi 2019 Ganti Presiden, ia merasa memang tidak perlu izin, tapi pemberitahuan seperti layaknya demo-demo biasa. Jika dalam aksi-aksi itu ada fintah, tentu berbeda karena masuk ke penistaan terhadap pejabat publik.
“Kalau yang melakukan persekusi, itulah yang harusnya ditangkap karena melakukan pelanggaran hukum,” kata Mahfud.
Untuk itu, ia mengimbau penegakan hukum memang harus netral, apalagi di beberapa kasus terasa ada penegakan hukum yang tidak netral. Ia merasa, negara akan kacau jika penegakan hukum tidak netral.
Mahfud menambahkan, nasionalisme saat ini tidak perlu diungkapkan dengan membeli peralatan-peralatan perang yang canggih. Tapi, nasionalisme dapat dilakukan dengan mewujudkan penegakan hukum dan keadilan.
“Sebenarnya kalau jadi wapres kemarin itu yang saya tekankan, tapi ndak jadi ya sudah,” ujar Mahfud diiringi tawa, yang turut disambut tawa dan tepuk tangan riuh hadirin Dialog Kebangsaan. (rci/red)
