Amerika Serikat (AS) kembali menunjukkan superioritasnya dalam perdagangan global. Kali ini Indonesia yang menjadi korban hegemoni AS.

Dalam dokumen yang dipublikasikan Organisasi Perdagangan Dunia (World Trade Organization/WTO) pada 6 Agustus 2018, AS meminta WTO menjatuhkan sanksi sebesar 350 juta dolar AS atau setara dengan Rp 5 triliun kepada Indonesia.

Permintaan untuk menjatuhkan sanksi kepada Indonesia ini dilakukan setelah sebelumnya Pemerintah AS mengajukan keberatan ke WTO terkait regulasi impor produk hortikultura dan peternakan yang diberlakukan oleh Indonesia.

Dalam nota keberatannya, intinya AS tidak mau lagi ada pengaturan tentang waktu untuk mengajukan perizinan impor dan tidak mau lagi ada waktu pemasukan komoditas. Gugatan tersebut dikabulkan. Indonesia sempat mengajukan upaya banding atas putusan tersebut tapi tak membuahkan hasil.

Bukan kali ini saja Indonesia kalah banding saat menghadapi AS di WTO. Pada 2011 silam, badan Dispute Settlement Body (DSB) WTO mementahkan gugatan Indonesia terkait larangan ekspor rokok kretek Indonesia ke AS.

Kemudian pada akhir 2017 lalu, Indonesia dinyatakan kalah dari AS dalam gugatannya di WTO terkait produk kertas yang diekspor ke AS. Gugatan yang dilayangkan Indonesia ini terkait pengenaan kebijakan anti-dumping dan anti-subsidi yang diterapkan AS atas produk-produk kertas berlapis (coated paper) asal Indonesia.

Dan, kali ini Indonesia kembali tak berkutik menghadapi AS di WTO. Keberatan AS terkait regulasi impor produk hortikultura dan peternakan ini telah dijawab oleh Indonesia melalui revisi aturan setingkat menteri.

Ada dua Peraturan Menteri Perdagangan (Permendag) dan dua Peraturan Menteri Pertanian (Permentan) yang akhirnya direvisi pemerintah.

Kementerian Perdagangan (Kemendag) mengeluarkan Permendag Nomor 64 Tahun 2018 tentang perubahan keempat atas Permendag Nomor 30 Tahun 2017 tentang ketentuan impor produk hortikultura. Serta Permendag Nomor 65 Tahun 2018 tentang perubahan ketiga atas Permendag Nomor 59 Tahun 2016 tentang ketentuan ekspor dan impor hewan dan produk hewan.

Sementara itu, Kementerian Pertanian (Kementan) telah merevisi peraturan rekomendasi impor produk hortikultura (RIPH) yang tercantum dalam Permentan Nomor 38 Tahun 2017 menjadi Permentan Nomor 24 Tahun 2018. Selain itu, Kementan juga melakukan perubahan Permentan Nomor 26 Tahun 2017 menjadi Permentan 33 Tahun 2018 tentang Penyediaan dan Peredaran Susu Segar.

Sekjen Kementan Syukur Iwantoro mengakui revisi aturan tersebut dilakukan guna mengikuti ketentuan WTO setelah adanya gugatan dari AS. Aturan tersebut diadukan oleh AS karena dianggap tidak sesuai dengan Appellate Body (AB) yang telah ditetapkan oleh WTO.

Agar selaras dengan ketentuan WTO. Setidaknya ada sembilan peraturan yang harus diubah pemerintah.

Pertama adalah pembatasan periode permohonan dan masa berlaku persetujuan impor produk hortikultura, pelarangan perubahan data jenis, jumlah produk impor yang diizinkan, ketentuan pelabuhan masuk serta asal negaranya, persyaratan realisasi impor sebesar 80 persen, dan pelarangan atau pembatasan impor produk hortikultura pada masa panen.

Kemudian, harus dimuat juga perihal persyaratan kapasitas dan kepemilikan fasilitas penyimpanan, pembatasan penggunaan penjualan dan distribusi produk impor, referensi harga cabai dan bawang merah segar untuk konsumsi, ketentuan produk hortikultura yang tidak dapat diimpor setelah 6 bulan masa panen, dan rezim perizinan impor produk hortikultura.

Dengan perubahan peraturan ini, maka akses pasar untuk produk makanan, tanaman dan produk hewan, termasuk apel, anggur, citrus, kentang, bawang, bunga, jus, buah kering, sapi, ayam dan daging sapi dari AS sudah terbuka. Kini Negeri Paman Sam tersebut bisa mengajukan izin dan memasukkan ketiga komoditas tersebut ke Indonesia setiap tahun.

Selama ini nilai perdagangan Indonesia dengan Amerika Serikat selalu surplus. Pada 2011, nilai ekspor Indonesia ke

AS mencapai 16,5 miliar dolar AS, sementara impor Indonesia dari AS 10,8 miliar dolar AS.

Di tahun 2012, nilai ekspornya mencapai 14,9 miliar dolar AS dan impornya 11,6 miliar dolar AS. Kemudian di tahun 2013, nilai ekspornya mencapai 15,7 miliar dolar AS dan impornya 9,1 miliar dolar AS.

Selanjutnya pada 2014, nilai ekspornya mencapai 16,5 miliar dolar AS dan impornya 8,2 miliar dolar AS. Pada tahun 2015, nilai ekspornya mencapai 16,2 miliar dolar AS dan impornya 7,6 miliar dolar AS. Kemudian pada 2016, nilai ekspornya mencapai 15,3 miliar dolar AS dan impornya 7,3 miliar dolar AS.

Kekalahan Indonesia di WTO ini tentunya akan berdampak signifikan pada industri pertanian di dalam negeri. Pasar domestik bakal dibanjiri oleh produk pertanian impor. Tak hanya produk dari AS tetapi juga akan dibanjiri produk-produk pertanian dari negara-negara anggota WTO lainnya.
