JAKARTA,Pesisirnasional.com- Terpidana kasus pembunuhan pegiat HAM Munir Said Thalib, Pollycarpus Budi Hariyanto telah dinyatakan bebas dari hukuman pada Rabu (29/8). Pihak Istana pun meminta masyarakat untuk menghormati proses hukum yang telah berjalan.
“Semua orang harus menghormati proses hukum itu sendiri,” kata Pramono di kantornya, Jakarta, Rabu (29/8).
Menurutnya, kasus Pollycarpus ini merupakan persoalan murni hukum dan telah divonis bersalah. Lembaga eksekutif tak bisa mengintervensi persoalan hukum yang ada. Sebab, tiga lembaga yang ada yakni yudikatif, eksekutif, dan legislatif masing-masing bersifat mandiri. Kasus Pollycarpus inipun merupakan kewenangan kehakiman.
“Yang namanya eksekutif tidak boleh intervensi dalam persoalan hukum itu, karena ini benar-benar kewenangan kehakiman,” tambah dia.
Pramono juga menyampaikan, hukuman yang dijalani Pollycarpus itupun menunjukan proses hukum yang telah berjalan. Proses hukum juga dikatakannya telah dimulai dari pemerintahan sebelumnya.
“Proses ini dimulai dari pemerintahan-pemerintahan sebelumnya. Bukan hanya di pemerintahan pada saat Pak Jokowi,” ucap Pramono.
Kendati demikian, Pramono mengatakan pemerintah pasti akan menyelesaikan kasus-kasus pelanggaran HAM jika terdapat bukti-bukti baru.
“Semua hal yang berkaitan pelanggaran HAM, kalau ditemui fakta novum baru ya pasti akan (diselesaikan),” tutupnya.
Sementara, Wakil Presiden Republik Indonesia Jusuf Kalla (JK) menanggapi terpidana kasus pembunuhan Munir, Pollycarpus yang telah selesai menjalani bebas bersyarat. JK mengatakan, apabila bebasnya Pollycarpus ini sesuai dengan aturan maka tidak perlu dipersoalkan.
“Kalau sesuai aturan ya silakan, karena memang ada aturan bebas bersyarat tiap tahun,” ujar JK di Balai Kartini, Rabu (29/8).
Adapun, Pollycarpus hari ini telah selesai menjalani masa pembebasan bersyaratnya. Pollycarpus sebelumnya mendapatkan pembebasan bersyarat pada 2014.
Setelah itu, mantan Pilot Garuda Indonesia tersebut wajib lapor di Balai Pemasyarakatan, Kementerian Hukum dan HAM Jawa Barat. Pollycarpus tinggal melaporkan diri untuk terakhir kalinya pada hari ini di Balai Pemasyarakatan sebelum resmi dinyatakan bebas murni.
Pollycarpus dihukum selama 14 tahun melalui putusan peninjauan kembali yang diajukannya, 2 Oktober 2013. Putusan itu lebih ringan dibanding putusan Mahkamah Agung tertanggal 25 Januari 2008 yang memvonis Pollycarpus 20 tahun penjara.
Hukuman 14 tahun penjara itu kemudian dipotong masa tahanan 2 tahun yang telah dijalani Pollycarpus saat kasus pembunuhan Munir pertama kali disidangkan. Putusan kasasi tertanggal 3 Oktober 2008, menjatuhkan pidana 2 tahun penjara. Ia mulai ditahan sejak 19 Maret 2005. Kala itu Pollycarpus seharusnya bebas pada 19 Maret 2007. Tapi dengan remisi 3 bulan, dia terhitung bebas sejak 25 Desember 2006. (rci/red)
