Aksi Taggar Pilpres 2019, Ini Arahan Kapolri

JAKARTA, Pesisirnasional.com Polri menerbitkan arahan kepada jajaran anggota intelijen dan keamanan di kepolisian satuan wilayah tingkat daerah atau kepolisian daerah (polda) untuk menyikapi sejumlah aksi deklarasi dalam bentuk tagar calon presiden (capres). Arahan itu diterbitkan dalam bentuk surat telegram bernomor STR/1852/VIII/2018 tertanggal 30 Agustus 2018 dan ditandatangani oleh Kepala Badan Intelijen Keamanan (Baintelkam) Polri Komisaris Jenderal Lutfi Lubihanto.

Kepala Divisi Humas Polri Inspektur Jenderal Polisi Setyo Wasisto mengatakan, kegiatan menyampaikan aspirasi dan unjuk rasa memang diatur oleh UU nomor 9 tahun 1998. Namun, dalam pasal 6, beberapa poin harus dipedomani oleh setiap orang yang akan menyampaikan aspirasi.

Setyo mengungkapkan, ada lima poin yang harus dipedomani oleh setiap orang yang akan menyampaikan aspirasi. Jika salah satu daru lima hal tak terpenuhi, kata Setyo, aparat kepolisian berhak untuk membubarkan penyampaian pendapat aspirasi.

“Karena polisi menganggap kalau salah satu tidak terpenuhi bisa terjadi gangguan keamanan dan ketertiban,” ujarnya, Senin (3/8).

Lima hal itu, pertama, dalam menyampaikan pendapat di muka umum berkewajiban dan bertanggung jawab untuk menghormati hak dan kebebasan orang lain. Kedua menghormati aturan-aturan moral yang diakui umum, ketiga menaati hukum dan ketentuan peraturan perundang-undangan yang berlaku. Keempat menjaga dan menghornati keamanan dan ketertiban umum. Kelima menjaga keutuhan persatuan dan kesatuan bangsa.

Dalam penilaian suatu penyampaian aspirasi dan pendapat, Setyo menuturkan, Polri melihat apakah rentan terjadi konflik atau tidak. Ketika hal tersebut terjadi, polisi bisa mengambil keputusan sesuai dengan pasal 15, di mana pasal tersebut menyampaikan Polri bisa membubarkan pelaksanaan penyampaian pendapat di muka umum.

“Kalau dia tidak mau dibubarkan maka dia dikenakan UU pidana pasal 211 sampai 218,” ujarnya.

Mengenai surat telegram tersebut, jenderal bintang dua ini menyebut hal tersebut hanya mengingatkan setiap anggota di wilayah untuk mempedomani aturan tersebut. “Aturannya sebenarnya sudah ada hanya pelaksanaannya kadang-kadang di wilayah lupa tidak mempedomani apa yang sudah diatur,” katanya.

Setyo menegaskan, Polri akan bersikap netral dan tak mendukung salah satu gerakan dukungan capres. Ia menyebut, dalam mengambil keputusan Polri hanya melihat jangan sampai hal tersebut dapat menjadi pemicu konflik. Ia pun menuturkan, Polri tidak akan masalah jika salah satu gerakan dukungan capres tidak mendapat penolakan di suatu daerah.

“Kalau dibilang polisi berpihak kalau yang datang duluan pendukung #Jokowi2periode kalau ada penolakan sama juga (akan dibubarkan). Kalau masyarakat menerima tidak masalah. Kalau mempermasalahkan itu bahaya maka timbul saling ricuh,” katanya.

Dalam surat telegram disebutkan ada empat aksi dukungan capres yang perlu mendapatkan atensi yaitu #2019GantiPresiden, #2019TetapJokowi, #Jokowi2Periode, dan #2019PrabowoPresiden. Untuk #2019GantiPresiden dinyatakan, bahwa kegiatan tersebut merupakan bentuk penyampaian pendapat di muka umum sebagaimana diatur dalam Undang-undang Nomor 9 Tahun 1998 yang wajib diberitahukan secara tertulis kepada Polri.

Penyelenggara aksi #2019GantiPresiden pun dinyatakan wajib serta bertanggung jawab pada lima hal yakni menghormati hak-hak orang lain, menghormati aturan-aturan moral yang diakui hukum, menaati hukum dan ketentuan peraturan perundang-undangan yang berlaku, menjaga dan menghormati keamanan dan ketertiban umum, serta menjaga keutuhan persatuan dan kesatuan bangsa.

Sementara itu, untuk #2019TetapJokowi, #Jokowi2Periode, dan #2019PrabowoPresiden dinyatakan Polri sebagai kegiatan yang mengarah kepada politik sebagaimana diatur dalam Peraturan Pemerintah Nomor 60 Tahun 2017. Dengan demikian, Polri menyatakan ketiga kegiatan itu wajib memberitahukan secara tertulis kepada Polri dan pemohon wajib melengkapi persyaratan yang harus dipenuhi sebagaimana tertuang dalam Pasal 19 PP No. 60/2017.

Salah satu penggagas gerakan #2019GantiPresiden, Mardani Ali Sera meminta masyarakat menilai sendiri apakah kebebasan berpendapat di Indonesia berkembang dengan baik. Hal ini menanggapi pernyataan Presiden Joko Widodo yang memperbolehkan memberikan pendapat namun harus sesuai aturan.

“Kami serahkan pada publik untuk menilai adakah demokrasi, khususnya menyampaikan pendapat, berkembang di negeri ini,” kata Mardani dilansir Republika, Ahad (9/2).

Ia mengatakan, gerakan #2019GantiPresiden adalah hak warga negara yang diatur oleh Undang-undang. Ia pun merasa selama ini telah menyampaikan pendapat bersama rekan-rekannya dengan cara yang benar sesuai aturan yang berlaku.

Mardani mengungkapkan, selama ini selalu mengurus perizinan ketika akan melakukan gerakannya tersebut. Bahkan, selain mengurus perizinan, pemberitahuan juga selalu dilakukan ketika akan melakukan deklarasi di wilayah manapun di Indonesia.

“Gerakan #2019GantiPresiden adalah hak warga negara dan cara penyampaiannya juga diatur secara konstitusional sesuai dengan UU No 9 tahun 1998, sehingga tidak ada alasan yang tepat bagi Pemerintah menghalangi masyarakat,” katanya menegaskan. (rci/red)
